SAN JOSE FAMILY LAW ATTORNEY FOR DOMESTIC PARTNERSHIPS
DOMESTIC PARTNER LAWYERS IN CAMPBELL, CUPERTINO, AND THE SAN FRANCISCO BAY AREA
California’s 2003 domestic partnership law provides substantially increased community property rights to same-sex couples and unmarried heterosexual couples over sixty-five who have registered as domestic partners. The partners will have the same community property rights as married couples unless they specifically opt-out of community property rights at the time they register.
DOMESTIC PARTNERSHIP ATTORNEYS IN SAN JOSE
The Dominion Law Group, LLP, experienced family law attorneys, can explain the new law to you and provide advice regarding your rights and responsibilities under the California domestic partnership laws.
We handle all of the legal aspects of the dissolution of domestic partnerships, including community property division, property settlement involving real estate, and child custody and visitation rights for same-sex couples with children.
YOUR RIGHTS UNDER PREVIOUS DOMESTIC PARTNERSHIP LAWS
While California’s previous domestic partnership laws did not provide the same community property rights, the new law retroactively confers those rights to registered domestic partners who have not opted out of these rights.
As a result of the new law, dissolution of a domestic partnership (domestic partner divorce) will be similar to the dissolution of a marriage, in which community property needs to be divided equally among the two partners.
